NYSACDL Denounces Senate Majority’s Plans To Change Bail Laws

NYSACDL thanks the Assembly, Senate and Governor for enacting a true progressive bail reform law. However, we join all defenders, civil rights and human rights groups in denouncing the Senate Majority’s reflexive reaction to a negative and false PR campaign led by pro-carceral prosecutors and law enforcement agencies. For decades, unaffordable money bail was used to coerce guilty pleas. Any framework that allows judges to detain or remand individuals based on a prediction that they are dangerous, can and will not only further eradicate the presumption of innocence, it will result in further mass incarceration, especially of people of color. New York's new bail reform law is truly progressive because it seeks not only to end mass incarceration but to eliminate racial disparities. Since its enactment, hundreds of individuals have been reunited with their families, able to go to work and/or receive necessary treatment. As such, we urge our Governor and the Senate Majority to adhere to their earlier principles when they first enacted our progressive bail laws and to stand up to baseless and groundless political propaganda.
