DMV Refusal Hearings in the Wake of COVID-19 with Steve Epstein

The Department of Motor Vehicles has begun holding refusal hearings via Webex. The major changes for those that have not done one of these is that DMV conducting hearing without "in person" appearances. Participants (motorist, witnesses, and counsel) can use phone or computer access for "teleconference." Although Webex has the capability, no video options are activated, meaning witnesses, counsel and the ALJ cannot be seen. If participants are accessing via computer exhibits can be viewed but not by witnesses calling in via phone. All evidence must be submitted 7 days in advance by motorist's counsel. This seminar will familiarize counsel with the new procedures being used by DMV to conduct DMV refusal hearings, prepare them to make timely objections to preserve appellate arguments regarding the new procedures and be aware of strategies to gain an advantage from the new procedures.
